General Terms

Softmare Arts requires clients to be thorough and clear. If you do not own a visual reference, please be as descriptive as possible (example photos are encouraged). Rude or unfair behavior may result in cancellation and refund of your project. Softmare Arts reserves the right to decline commissions for failing to review these terms.

Payment

All commissions are to be paid in full before your project is started. Failure to pay within 2 weeks may result in a cancellation or hold of your commission, this will delay your artwork's completion. Softmare Arts is not responsible for any conversion fees for clients outside of the US. Payment done through paypal must use 'goods and services' to ensure buyer's protection. Tips, while appreciated, will not count towards your project in any way.

Process

Sketch wips (or 'work in progress') screenshots are always sent to the client for approval before completion. Clients reserve the right to check in for progress at any time. Time windows for completion vary due to life factors, and while the average ETA is 3-5 weeks (~20-35 days) Softmare Arts tries not to exceed 8 weeks (~56 days) of waiting time and notifies all clients of possible delays.

Customer Satisfaction

Softmare Arts strives for complete client satisfaction. Every step of the way, clients are expected to point out mistakes or propose changes, these edits are at no cost to you so long as the artwork is still in early stages. Once completed, the artwork can no longer be altered in a significant way, as files with layer information gets deleted over time. Small, overlooked edits are always possible (adding small markings, missing piercings, etc).

Copyright/Usage Policy

I, the artist (Softmare Arts), hold every right to the produced artwork, not the client.

As the copyright holder, I reserve the right to:

• Use the artwork for self-promotion across any platform or website.
• Include the artwork in published materials, such as art books.
• Display the piece in any location or portfolio of my choosing.
• Post the artwork online wherever I see fit.

The client is granted limited rights to the commissioned artwork, as follows:

• Personal use only, unless a separate agreement has been made.
• Permission to print the artwork and claim ownership of their character(s).
• Use the artwork for self-promotion with clear credit given to the artist (Softmare Arts).

Violating these terms will result in the retraction of usage rights for the commissioned piece.

The following actions are considered copyright infringement:

• Commercial use of the artwork without explicit permission.
• Claiming authorship or creation of the artwork.
• Editing, modifying, or altering the artwork without consent.

Canceling/Refunding Policy

Refunds are strictly prohibited unless Softmare Arts is physically unable to complete the commissioned artwork. It is the client's responsibility to communicate any concerns or desired changes early in the process.

Softmare Arts reserves the right to cancel a commission and issue a full refund at any time after payment has been received.

If payment has not yet been sent, the client is free to cancel the commission at any time.

CHARGEBACKS ARE NOT TOLERATED

Initiating a chargeback will result in:

• Immediate revocation of rights to the commissioned artwork
• Placement on a public or private blacklist
• A permanent ban from future commissions
